All participants and models are hereby required to review these Terms and Conditions in their entirety, and by providing a digital signature below, you​ acknowledge your understanding of and formal agreement to be bound by these terms.

Photography Workshop Release/Terms & Conditions Contract

1. Scope of Engagement

The Model and Participants agree to participate in a photography workshop for the purpose of educational instruction and portfolio building. The session may include specialized setups such as off-camera flash, ambient light techniques, and stylized fashion, beauty, or fine-art concepts.

2. Compensation & Fees

  • Workshop Revenue: In alignment with the Organizer’s commitment to fair professional practices, Compensation for the Model shall be determined by a fixed rate corresponding to a 10–15 person workshop capacity.

  • Students' payment is required at the time of registration to secure a workshop spot.

  • Model Payment Timeline: Payment will be issued to the Model following the conclusion of the workshop.

  • Images: As additional compensation, the Model will receive low-resolution JPEGs, edited digital files from the Organizer, and/or participants for personal portfolio use. The photographer(s) will not release any RAW files or unedited photos.

3. Grant of Rights

The Model hereby grants the Organizer and the participating workshop students the irrevocable right to use the photographs taken during the workshop for:

  • Hobbist and or Professional portfolios and websites.

  • Social media sharing.

  • Marketing for the organizer only, for Educational materials and future workshop advertisements

The Model waives the right to inspect or approve the finished product or the advertising copy that may be used in connection with the images. 

4. Model’s Usage Rights

  • The Model retains the right to use images provided by the Organizer and participants for their own self-promotion, social media, and modeling portfolio. 

  • The Photographer(s) retain all copyright to all digital photos, edited or unedited. It is ILLEGAL to copy or reproduce these photographs or videos elsewhere without the Photographer's permission, and violators of this Federal Law will be subject to its civil and criminal penalties.

5. Professional Conduct

  • The Organizer maintains a professional, respectful environment. Any inappropriate participant(s) and or model(s) behavior will be handled immediately by the Organizer. If the behavior persists, the participant will be asked to leave the workshop location without a refund and will be banned from any future workshops.  If the behavior comes from a model, he/she will be asked to leave the workshop location without payment and will be banned from any future workshops.

  • The Model agrees to arrive on time and prepared with any pre-discussed wardrobe or styling requirements. Payment will be given at the end of the workshop. 

6. Liability Release

The Model(s) and the participant(s) move and pose at their own risk. The model(s) and participant(s) release Ryan Sakamoto Photography from any liability for damages of any kind, whether mental, emotional, physical, or otherwise, arising from the production of the photography workshop before, on, or after the event date.

7. Participant(s) Image Usage & Limitations

  • Educational Purpose: Images captured by participant(s) during the workshop are intended for portfolio and self-promotional use only (e.g., website, social media, printed portfolio).

  • Commercial Restriction: Participants(s) are strictly prohibited from selling, licensing, or distributing images to third parties, including but not limited to stock photography websites (e.g., Getty, Shutterstock, Adobe Stock), commercial advertisements, or print-on-demand services, without the prior written consent of both the Organizer and the Model.

8. To acknowledge the collaborative nature of this workshop environment 

  • Model(s) agree to credit the photographer(s)

  • Photographer(s), agree to credit the model(s)

  • Both parties agree to credit  Ryan Sakamoto for images taken on the workshop day. 

9. Weather Contingency Policy

  • "Rain or Shine" Commitment: Due to the nature of on-location photography in Hawaii, the workshop is generally considered a "Rain or Shine" event. Participants and Models should be prepared for various ambient lighting conditions and light tropical weather.

  • Organizer’s Discretion: In the event of severe weather that poses a safety risk to participants or equipment (e.g., high-wind warnings, flash flood alerts, or heavy rains or thunderstorms), the Organizer reserves the right to:

    1. Relocate: Move the session to a sheltered or indoor location.

    2. Reschedule: Postpone the session to a mutually agreed-upon backup date.

    3. Refunds will be offered for bad Weather conditions: If the workshop proceeds as scheduled or a viable indoor alternative is provided, no refunds will be issued.

 

By signing this Agreement, you confirm that you are at least 18 years old and are legally capable of entering into this contract. I have read and understand this agreement, including the terms and conditions, and agree to be bound by these terms: I acknowledge that my electronic signature is the legal equivalent of my manual signature.
